{"id":807,"date":"2022-10-13T20:27:19","date_gmt":"2022-10-13T20:27:19","guid":{"rendered":"https:\/\/sites.sandiego.edu\/cpil-blog\/?p=807"},"modified":"2022-10-13T20:27:19","modified_gmt":"2022-10-13T20:27:19","slug":"medical-board-of-california-supports-law-to-strengthen-punishment-of-physicians-who-disseminate-misinformation","status":"publish","type":"post","link":"https:\/\/sites.sandiego.edu\/cpil-blog\/2022\/10\/13\/medical-board-of-california-supports-law-to-strengthen-punishment-of-physicians-who-disseminate-misinformation\/","title":{"rendered":"Medical Board of California Supports Law to Strengthen Punishment of Physicians Who Disseminate Misinformation"},"content":{"rendered":"<h3>By Carter Cordura<\/h3>\n<p>On June 1, 2022, in a <a href=\"https:\/\/perma.cc\/JV8R-LXLY\">letter<\/a> to Assemblymember Low, the Medical Board of California (MBC) took a stance on <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2098\">AB 2098 (Low)<\/a>, stating it would \u201csupport if amended.\u201d\u00a0 After its amendment on April 20, 2022, the bill largely reflected MBC\u2019s desired changes. Governor Gavin Newsom signed AB 2098 into law on September 30, 2022 (Chapter 938, Statutes of 2022).<\/p>\n<p>AB 2098 expressly provides that the dissemination of misinformation or disinformation related to COVID-19 by physicians and surgeons constitutes unprofessional conduct.\u00a0 The law targets three types of false or misleading information relating to the COVID-19 pandemic: nonfactual information regarding \u201cthe nature and risks of the virus\u201d; false statements regarding its \u201cprevention and treatment\u201d; and misinformation or disinformation regarding \u201cthe development, safety, and effectiveness of COVID-19 vaccines.\u201d<\/p>\n<p>MBC is required to take action against any licensed physician and surgeon charged with unprofessional conduct.\u00a0 Thus, the law extends MBC\u2019s obligation to COVID-19 misinformation cases.<\/p>\n<p>The following statutory term definitions apply:<\/p>\n<ul>\n<li>\u201cDisseminate\u201d means the conveyance of information from the licensee to a patient under the licensee\u2019s care in the form of treatment or advice.<\/li>\n<li>\u201cMisinformation\u201d means false information that is contradicted by contemporary scientific consensus contrary to the standard of care.<\/li>\n<li>\u201cDisinformation\u201d means misinformation that the licensee deliberately disseminated with malicious intent or an intent to mislead.<\/li>\n<\/ul>\n<p>AB 2098 will make it easier for MBC to punish doctors who deliberately spread false information about COVID-19 and its treatments.\u00a0 The California Medical Association (CMA) and ProtectUS are co-sponsors of the bill.\u00a0 CMA supports the bill to protect against physicians who spread disinformation. ProtectUS supports the bill because physicians who choose to spread misinformation disproportionately affect the lives of the most vulnerable (i.e., the \u201csick\u201d).<\/p>\n<p>Opposition expressed concerns about the general \u201cscientific consensus\u201d terminology and the potential physician speech curtailment that could occur under it. Voice for Choice Advocacy opposes the bill arguing MBC already has measures in place to discipline physicians who maliciously spread misinformation. Further, it believes AB 2098 is overly broad and will be impossible to implement. Californians for Good Governance opposes the bill because it is an unconstitutional restriction on free speech; it is not narrowly tailored to serve the compelling state interest of providing the public with accurate information about COVID-19.<\/p>\n<p>On October 4, 2022, plaintiffs Mark McDonald and Jeff Barke, physicians licensed in California, filed a <a href=\"https:\/\/drive.google.com\/file\/d\/1-Cwz7U8EaZNjHFhZumBPe4Nj6lB8Fqvi\/view?usp=sharing\">complaint<\/a> against members of MBC and Attorney General Rob Bonta (<strong><em>McDonald, et al. v. Kristina D. Lawson, et al.<\/em>, Case No. 8:22-cv-01805 (C.D. Cal.)<\/strong>).
