{"id":73,"date":"2020-03-02T22:25:29","date_gmt":"2020-03-02T22:25:29","guid":{"rendered":"https:\/\/sites.sandiego.edu\/cpil-blog\/?p=73"},"modified":"2020-03-02T22:25:29","modified_gmt":"2020-03-02T22:25:29","slug":"oal-approves-contractors-state-license-boards-proposed-emergency-rulemaking-to-increase-fees","status":"publish","type":"post","link":"https:\/\/sites.sandiego.edu\/cpil-blog\/2020\/03\/02\/oal-approves-contractors-state-license-boards-proposed-emergency-rulemaking-to-increase-fees\/","title":{"rendered":"OAL Approves Contractors\u2019 State License Board\u2019s Proposed Emergency Rulemaking to Increase Fees"},"content":{"rendered":"<h3>By Mariela Romo<\/h3>\n<p>On December 19, 2019, the Office of Administrative Law (OAL) <a href=\"https:\/\/perma.cc\/S9DP-9J7D\">approved<\/a> the Contractors\u2019 State License Board\u2019s (CSLB) proposed emergency regulations to <a href=\"https:\/\/www.cslb.ca.gov\/Resources\/LawsAndRegulations\/CCR811_OrderOfAdoption.pdf\">amend<\/a> section 811, Title 16 of the California Code of Regulations (CCR) to raise certain CSLB renewal fees to their statutory maximums. Specifically, renewal fees for active licensees increased from $360 to $450, renewal fees for inactive licensees increased from $180 to $225, and renewal fees for home improvement salesperson registration increased from $75 to $95.<\/p>\n<p>In its <a href=\"https:\/\/perma.cc\/6JNJ-BD4E\">Findings of Emergency<\/a>, the Board determined that emergency regulations were necessary in order to address CSLB\u2019s structural budget imbalance and diminishing funds. Concerns that CSLB\u2019s expenditures have increased while license renewals have decreased and a declining Contingent Fund also prompted the Board to initiate emergency rulemaking. According to the findings, if fees were not raised, CSLB\u2019s ability to carry out its enforcement efforts and licensing, investigative, public outreach, and examination functions would be impacted. Furthermore, the Board projected that without the fee increase, there would be insufficient funds at the beginning of the 2020-2021 fiscal year.<\/p>\n<p>At its December 12, 2019 <a href=\"https:\/\/perma.cc\/3NCW-9REX\">meeting<\/a>, the CSLB\u2019s Legislative Counsel explained that the increased fees are expected to increase revenue by two and a half million dollars in 2020 and by six million dollars in 2021 and 2022. [<a href=\"https:\/\/perma.cc\/5YNV-5K2K\">Agenda Item G-3<\/a>]. Furthermore, he reported that the fee increase will allow CSLB to review other fees and complete a fee study in order to determine if those other fee categories should also be increased.<\/p>\n<p>The Board unanimously voted to file emergency rulemaking at its September 24, 2019 <a href=\"https:\/\/perma.cc\/C2WX-ULME\">meeting<\/a>. [<a href=\"https:\/\/perma.cc\/PML5-XEMT\">Agenda Item H-1<\/a> at 193]. However, CSLB did not formally <a href=\"https:\/\/perma.cc\/F32H-GJKX\">notice<\/a> its intent to adopt emergency regulations until December 3, 2019. The <a href=\"https:\/\/perma.cc\/CZ35-AWFB\">new fee schedule<\/a> went into effect on February 1, 2020.
