Travelers Casualty Insurance Company of America<\/em><\/strong><strong>, Case No. 20-16858 (9th Cir.). <\/strong>\u00a0The <a href=\"https:\/\/drive.google.com\/file\/d\/1Ashe9Sr5HHcjlT7uDQI4JoVNqmdP_Guy\/view?usp=sharing\">opinion <\/a>affirmed the district court\u2019s order dismissing Petitioner Mudpie, Inc.\u2019s claims against its insurer, Travelers Casualty Insurance Company of America. Mudpie sought to recover\u2014under its comprehensive business insurance coverage policy\u2014losses suffered during the COVID-19 pandemic due to state and local emergency orders. The court held that the phrase \u201cphysical loss of or damage to\u201d would require the insured to allege a \u201cphysical alteration of its property\u201d in order to recover under the policy, and the policy\u2019s \u201cVirus Exclusion\u201d terminology barred coverage for Mudpie\u2019s claimed losses. <em>Mudpie, Inc. v. Travelers Cas. Ins. Co. of Am.<\/em>, 15 F.4th 885 (9th Cir. 2021).<\/p>\n<p>On March 4, 2020, Governor Newsom <a href=\"https:\/\/perma.cc\/AA8X-7BNS\">proclaimed<\/a> a state of emergency in California, ordering all residents of California to \u201cheed any orders and guidance of state and local public health officials, including, but not limited to, the imposition of social distancing measures, to control the spread of COVID-19.\u201d On March 16, 2020, the City and County of San Francisco issued an <a href=\"https:\/\/perma.cc\/DVB6-4SW3\">order<\/a> requiring all non-essential businesses \u201cto cease all activities at facilities located within the County except Minimum Basic Operations.\u201d<\/p>\n<p>On May 11, 2020, Mudpie filed a class action <a href=\"https:\/\/drive.google.com\/file\/d\/1dHAWZlRbmt_byiEwzUVLTyh1wAjV-YNk\/view?usp=sharing\">complaint<\/a> on behalf of itself and a putative class of all retailers in California that purchased comprehensive business insurance coverage from Travelers and were subsequently denied coverage for claims of lost business income following the state and local emergency orders. On June 3, 2020, Travelers filed a <a href=\"https:\/\/drive.google.com\/file\/d\/1I-195pfVWGYkEB1w9bUXCtja29PIvAuG\/view?usp=sharing\">Motion to Dismiss<\/a> the complaint on the grounds that the policy contained (as noted above) a Virus Exclusion that excepted coverage for any \u201closs or damage caused by or resulting from any virus, bacterium, or other microorganism that induces or is capable of inducing physical distress, illness, or disease,\u201d and that Mudpie did not allege facts demonstrating a \u201cdirect physical loss of or damage to\u201d the insured property.<\/p>\n<p>On September 14, 2020, the District Court for the Northern District of California filed an <a href=\"https:\/\/drive.google.com\/file\/d\/1BAS26BLmPvfscTZth2k5zPsxrmkkIiPm\/view?usp=sharing\">order<\/a> granting the motion to dismiss without prejudice, ruling that Mudpie failed \u201cto allege any intervening physical force beyond the government closure orders.\u201d The district court declined to consider Travelers\u2019 argument that the Virus Exclusion categorically barred recovery. Mudpie filed notice that no amended complaint would be filed and a Notice of Appeal to the Ninth Circuit Court of Appeals was filed on September 23, 2020, following the district court\u2019s dismissal with prejudice.<\/p>\n<p>The Ninth Circuit affirmed the district court\u2019s dismissal, holding that \u201cMudpie\u2019s claimed losses are not covered by the Policy,\u201d and that the district court \u201cdid not err by dismissing Mudpie\u2019s claims.\u201d <em>Mudpie<\/em>, 15 F.4th. at 893. \u00a0The Court also ruled on the issue of the Virus Exclusion, holding that \u201cthe Policy\u2019s Virus Exclusion bars coverage for Mudpie\u2019s claims\u201d because Mudpie did not dispute that \u201cthe Stay at Home Orders that impacted Mudpie\u2019s business were issued in response to the COVID-19 pandemic, and the point is not debatable.\u201d <em>Id.<\/em> at 894.<\/p>\n<p>Mudpie filed a petition for rehearing <em>en banc<\/em> on October 29, 2021.<\/p>\n<a class=\"synved-social-button synved-social-button-follow synved-social-size-32 synved-social-resolution-single synved-social-provider-facebook nolightbox\" data-provider=\"facebook\" target=\"_blank\" rel=\"nofollow\" title=\"Follow us on Facebook\" href=\"https:\/\/www.facebook.com\/CPILUSD\" style=\"font-size: 0px;width:32px;height:32px;margin:0;margin-bottom:5px;margin-right:5px\"><img loading=\"lazy\" decoding=\"async\" alt=\"Facebook\" title=\"Follow us on Facebook\" class=\"synved-share-image synved-social-image synved-social-image-follow\" width=\"32\" height=\"32\" style=\"display: inline;width:32px;height:32px;margin: 0;padding: 0;border: none;box-shadow: none\" src=\"https:\/\/sites.sandiego.edu\/cpil-blog\/wp-content\/plugins\/social-media-feather\/synved-social\/addons\/extra-icons\/image\/social\/circle\/64x64\/facebook.png\" \/><\/a><a class=\"synved-social-button synved-social-button-follow synved-social-size-32 synved-social-resolution-single synved-social-provider-twitter nolightbox\" data-provider=\"twitter\" target=\"_blank\" rel=\"nofollow\" title=\"Follow us on Twitter\" href=\"https:\/\/twitter.com\/cpilusd\" style=\"font-size: 0px;width:32px;height:32px;margin:0;margin-bottom:5px\"><img loading=\"lazy\" decoding=\"async\" alt=\"twitter\" title=\"Follow us on Twitter\" class=\"synved-share-image synved-social-image synved-social-image-follow\" width=\"32\" height=\"32\" style=\"display: inline;width:32px;height:32px;margin: 0;padding: 0;border: none;box-shadow: none\" src=\"https:\/\/sites.sandiego.edu\/cpil-blog\/wp-content\/plugins\/social-media-feather\/synved-social\/addons\/extra-icons\/image\/social\/circle\/64x64\/twitter.png\" \/><\/a>","protected":false},"excerpt":{"rendered":"<p>By Jackson Sullivan On October 1, 2021, the Ninth Circuit decided Mudpie, Inc. v.
