{"id":1112,"date":"2026-04-13T16:53:57","date_gmt":"2026-04-13T16:53:57","guid":{"rendered":"https:\/\/sites.sandiego.edu\/cpil-blog\/?p=1112"},"modified":"2026-04-13T16:53:57","modified_gmt":"2026-04-13T16:53:57","slug":"the-department-of-insurance-continues-rulemaking-to-address-intervenor-compensation-under-prop-103","status":"publish","type":"post","link":"https:\/\/sites.sandiego.edu\/cpil-blog\/2026\/04\/13\/the-department-of-insurance-continues-rulemaking-to-address-intervenor-compensation-under-prop-103\/","title":{"rendered":"The Department of Insurance Continues Rulemaking to Address Intervenor Compensation Under Prop 103"},"content":{"rendered":"<h3>By Charlotte Fuchs<\/h3>\n<p>On February 13, 2026, the Department of Insurance (DOI) <a href=\"https:\/\/perma.cc\/5P33-ZYUA\">released<\/a> the <a href=\"https:\/\/perma.cc\/5QTF-2WVP\">amended text<\/a> of proposed regulations modernizing California\u2019s intervenor and Administrative Hearing Bureau processes under Proposition 103. Proposition 103, passed by voters in 1988, dictates that the Insurance Commissioner is responsible for ensuring that consumers do not pay insurance companies and intervenors more than is legally justified. This is achieved through intervenor participation to protect consumers from insurers\u2019 arbitrary or high rates.<\/p>\n<p>In its September 19, 2025, <a href=\"https:\/\/perma.cc\/8XDV-VEUP\">press release<\/a>, DOI announced Commissioner Lara\u2019s plan for a major change to the intervenor process to enhance transparency and public participation. On October 3, 2025, DOI issued its original <a href=\"https:\/\/perma.cc\/452W-B9V3\">Notice of Proposed Rulemaking<\/a> to begin the initial 45-day public comment period. After this comment period, the proposed text went under revision. On February 13, 2026, DOI posted its notice of the amended text, and the 15-day public comment period began. Currently, the amended text is being reviewed after this period.<\/p>\n<p>The current Intervenor and Administrative Hearing Bureau processes allow groups to intervene in rate-making hearings and \u2013 if successful \u2013 be awarded costs and expenses. The amended text would create firm timelines and regular status updates from administrative law judges and increase public access to rate proceeding documents through timely online posting of pleadings, hearing calendars, and decisions on its website.<\/p>\n<p>Additionally, these changes would drastically change the intervenor process by requiring intervenors to submit conflicts of interest and group funding from the last two years to be reviewed with their Petitions to Intervene, and their eligibility is subject to objection. If allowed to intervene, intervenors then could only receive compensation if their contribution is substantial and can only receive compensation from Commissioner-approved awards. DOI has given notice to insurers regarding the eligibility of Consumer Watchdog and Consumer Federation of California Education Foundation as intervenors, and allegedly, no other active consumer protection group was reached for eligibility verification.<\/p>\n<p>Commissioner Lara states the changes increase intervenor transparency, improve efficiency, and ensure that every dollar in the rate review process serves the public interest. Another goal stated is more public participation and access.<\/p>\n<p>However, this reform may lessen intervenor participation, which may decrease consumer protection in rate review hearings. First, when intervenors petition to intervene, they now must provide: a statement describing any actual or potential conflicts of interest from the prior 24 months, such as financial support conditioned on participation or representation of private clients; and funding sources for the prior 24 months, including identifying individuals who contributed at least 5% of the annual budget. Second, groups who can intervene are no longer able to get direct compensation for their work, and their contribution to the proceedings must be substantial to receive compensation. To qualify as a &#8220;substantial contribution,&#8221; an intervenor\u2019s participation must result in more &#8220;relevant, credible, and non-frivolous information&#8221; being available to the Commissioner than would have existed otherwise. Also, compensation may be reduced if the intervenor\u2019s work merely duplicates the efforts of the Department of Insurance staff or other parties. Lastly, services deemed &#8220;peripheral&#8221; or &#8220;promotional,&#8221; such as media engagement and general networking, are explicitly defined as non-substantive and ineligible for compensation.
