The amendments establish guidelines that permit certified LRSs to partner with eligible nonprofit organizations under specified conditions. Effective January 1, 2025, the revisions implement Business &amp; Professions Code Section 6155, which allows certified lawyer referral services to partner with eligible nonprofit organizations.<\/p>\n<p>The State Bar regulates LRSs through Title 3, Division 5, Chapter 3 of the Rules of the State Bar (LRS Rules). LRSs in California are State Bar-certified organizations that connect the public with qualified attorneys who meet specific experience and insurance requirements, serving as a mechanism to help consumers access legal aid and representation. LRSs must operate in compliance with regulatory standards that govern attorney screening, recordkeeping, complaint review, and insurance coverage. Certification provides the public with assurance that services meet minimum consumer protection requirements and that attorneys satisfy the eligibility criteria established by the State Bar. By regulating LRSs, the State Bar fulfills its mandate to protect the public interest and ensure that sufficient accountability processes are in place in the practice of legal services.<\/p>\n<p>The proposed amendments track with the Legislature\u2019s enactment of <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB3279\">AB 3279 (Committee on Judiciary) (Chapter 227, Statutes of 2024)<\/a>, which amended section 6155 to allow partnerships between LRSs and nonprofit organizations. The State Bar responded by enlisting the California Access to Justice Commission\u2019s (CalATJ) <a href=\"https:\/\/perma.cc\/ZS64-77GY\">analyses and recommendations<\/a>, which consulted with stakeholders and drafted revisions to integrate the statute&#8217;s requirements. At its November 20, 2025, meeting, the Board of Trustees discussed authorizing these amendments, with the goal of streamlining the process for trusted nonprofits, such as legal aid and community-based organizations, to more easily connect the public with more qualified and insured attorneys through certified LRSs.<\/p>\n<p>Under the <a href=\"https:\/\/perma.cc\/R7GL-CLAY\">proposed text<\/a> of Rule 3.800, newly defined terms are intended to provide a more consistent basis for interpretation and enforcement by more clearly outlining the scope of regulated activity and terminology throughout the chapter. Some of these terms include \u201cLawyer Referral Service\u201d or \u201cLRS,\u201d \u201cNonprofit Partner,\u201d \u201cLRS Partnership,\u201d and what constitutes a \u201cReferral\u201d in this line of service. Proposed Rules 3.830 through 3.833 manifest procedural notice requirements through which an LRS can partner with a nonprofit without requiring separate certification of the nonprofit organization itself. Instead, the LRS unilaterally notifies the State Bar of partnership approval. While the nonprofit may assist with promotion, coordination, and client navigation efforts, the certified LRSs retain sole responsibility for compliance with public safety, protection, and due process requirements.<\/p>\n<p>In accordance with CalATJ\u2019s recommendations, the rules aim to preserve LRS\u2019s duties to protect consumers while also allowing for more mechanisms for collaboration among nonprofit organizations. Further, the changes ease geographic restrictions in the LRS certification process and shorten the timeline of the recertification cycle, and address the challenges associated with recruiting attorneys and accessing regions that lack legal aid and representation. Finally, the amendments relieve administrative burdens and make it easier to operate or participate in an LRS to implement more modernized electronic notice procedures, simplify application requirements, clarify fee and waiver rules, and remove certain late-fee penalties.<\/p>\n<p>Members of the public were given the opportunity to provide feedback of the proposed amendments before the rules were finalized after they circulated for the regulatory 45-day public comment period. Since the public comment deadline passed on January 10, 2026, the State Bar staff reviewed comments and prepared potential recommendations for revisions before presenting them to the Board for final consideration. If these amendments are adopted, the Legislature\u2019s revisions to Business and Professions Code section 6155 would take effect, completing the final regulatory step.
